Nikon Corporation (hereinafter referred to as “NIKON”) provides the Nikon ID Service (hereinafter referred to as the “Service”), which provides a common account “Nikon ID” for more convenient access to the various services provided by NIKON.
These Nikon ID Terms of Use (hereinafter referred to as these “Terms”) set forth the terms of use that apply to customers regarding the Service operated by NIKON.
I. Application of the Service and These Terms
- 1. In order to use the Service, you must read, understand and agree to all of the terms and conditions of these Terms. If you do not agree to any part of these Terms, you will not be able to use the Service.
- 2. IF YOU ARE A RESIDENT OF ANY U.S. STATE OR OTHER JURISDICTION THAT HAS ENACTED DATA PRIVACY LEGISLATION THAT PERTAINS TO YOUR PERSONAL INFORMATION (COLLECTIVELY, “PRIVACY LAWS”), THIS IS NOTICE THAT SUCH PRIVACY LAWS MAY BE APPLICABLE TO THE PERSONAL INFORMATION YOU SUBMIT TO NIKON TO REGISTER FOR THE SERVICE, AND NIKON WILL USE SUCH PERSONAL INFORMATION FOR THE BUSINESS PURPOSE OF PROVIDING AND MANAGING THE SERVICE AND TO CONTACT YOU REGARDING THE SERVICE, ALL AS DESCRIBED IN THESE TERMS. FOR INFORMATION REGARDING NIKON’S COLLECTION AND USE OF PERSONAL INFORMATION AND YOUR RIGHTS WITH RESPECT THERETO, PLEASE REVIEW THE APPLICABLE PRIVACY NOTICES AVAILABLE AT Nikon ID Privacy Notice.
II. The Service and Various Services
- 1. Services provided by NIKON and its group companies (other than the Service) that allow login using a Nikon ID are hereinafter referred to as “Various Services.” The Service includes functions such as registering and managing Nikon IDs and logging into Various Services.
- 2. The Service is operated by NIKON, a Japanese corporation; however, the server that processes and stores data related to the use of the Service is located in Ireland.
- 3. In addition to agreeing to these Terms, you will also be required to agree to the corresponding Terms of Use for the Various Services in order to use respective Various Services. In addition, if there are any provisions in the Terms of Use for the Various Services that conflict with these Terms, then these Terms shall take precedence with respect to the Service.
III. Registration
- 1. Customers who wish to register for the Service must complete the registration procedure prescribed by NIKON (hereinafter referred to as “Registration Procedure”). Upon the customer’s correct completion of the Registration Procedure, NIKON will provide the customer a Nikon ID (hereinafter, a customer who has been given a Nikon ID is referred to as a “Member”).
- 2. Each Member is only allowed to register and hold one Nikon ID. Therefore, if you already have a Nikon ID, you cannot register a new Nikon ID.
- 3. By registering for the Service, you represent and warrant that the information you enter during the Registration Procedure must be current, accurate and truthful. The same applies to the information you enter after registration.
- 4. Any customer who has violated these Terms, the terms of any of the Various Services or any other services provided by NIKON in the past, or for other reasons deemed reasonably appropriate by NIKON may have their registration request rejected by NIKON.
IV. Management
- 1. If you wish to check or change information that you have registered as a Member with NIKON regarding the Service (hereinafter referred to as “Registered Information”), you can do so on the management screen of the Service. However, please note that if you make any changes, the information you enter must be current, accurate and truthful.
- 2. The management of all information used for Nikon ID login (including, but not limited to, an e-mail address and password; hereinafter referred to as “Authentication Information”) is to be done at the Member’s own responsibility and expense. Furthermore, Members must secure their Authentication Information and not permit any access to the Member’s account to the Service by any third party, including without limitation by disclosing, lending, transferring, buying, selling or pledging such Authentication Information to a third party.
- 3. Should the Member’s Registered Information change, or should the Member discover or suspect that their Authentication Information has been revealed to a third party, the Member is responsible and must change their Registered Information or their Authentication Information without delay.
- 4. The Member shall personally be liable for any and all liability and damage caused by the leakage of personal information of the Member, NIKON, or other Members, unauthorized use of said information by a third party, or unauthorized access by a third party due to the Member’s inadequate management of their Authentication Information. NIKON assumes no responsibility or liability whatsoever for such damage that results from the Member's mishandling of their Authentication Information.
V. Securing the Means of Communication
- 1. If access to the Internet is required when using the Service, the Member is responsible for preparing the necessary equipment, software, means of communication, etc. at their own expense, and will need to install and operate them appropriately. NIKON does not have any involvement in the preparation or method of a Member’s Internet access. All related costs will be borne by the Member.
VI. Member’s Responsibilities
- 1. In order to prevent any violations of the law or regulations and to ensure the smooth operation of the Service, NIKON prohibits Members from engaging in the following acts when using the Service. Please note that for the purposes of these Terms, “Prohibited Acts” refers not only to the Prohibited Acts described below, but also to all other prohibited acts stipulated in these Terms.
- a. Placing a burden on, interfering with, or disrupting the Service or the servers or networks to which the Service is connected, or engaging in acts that violate the terms of use, operating procedures, terms and conditions, and regulations of a network connected to for the use of the Service;
- b. Violating these Terms;
- c. Violating the terms of use for any of the Various Services;
- d. Harassing a third party, or any act that may be perceived as harassment, regardless of the method;
- e. Gathering or aggregating, or attempting to gather or aggregate, the personal information of other customers or Members;
- f. Sending junk mail, spam mail, bulk mail, chain mail to NIKON or a third party, or soliciting other customers or Members;
- g. Any illegal acts or omissions whatsoever that violate applicable law or regulations;
- h. Copying, republishing, making derivative works of, or otherwise distributing all and/or any part of the Service to any other computer, server, website or other medium for any commercial purpose; and
- i. Engaging in any other activity that NIKON reasonably deems inappropriate.
- 2. If a Member’s conduct falls under one or more of the Prohibited Acts, or is reasonably deemed by NIKON as likely to fall under one or more of the Prohibited Acts, NIKON may, with or without notice to the Member, suspend part or all of such Member’s use of the Service and take other measures that NIKON reasonably deems appropriate. In the event of the infringement of the rights of or any damage and/or liability being incurred by NIKON, its affiliated companies, other customers or Members, or third parties arising out of or in connection with a Prohibited Act committed by a Member, the responsibility, and any and all damages, losses, liabilities, claims, and expenses (including but not limited to reasonable attorneys’ fees) resulting therefrom shall be the sole responsibility of the Member.
- 3. Members must promptly and reasonably comply with any specific instructions or requests from NIKON that are related to the Service and/or the Member’s use thereof.
- 4. Use of the Service is for personal, noncommercial use only. Members may not use the Service, whether in whole or in part, for commercial purposes. If a Member’s conduct constitutes commercial use, or is reasonably deemed by NIKON as likely to constitute commercial use, NIKON may, with or without notice, suspend part or all of such Member’s use of the Service and take other measures that NIKON deems appropriate (including seeking compensation for damages from the Member).
VII. No Warranty
- 1. NIKON makes no, and hereby disclaims all representations and/or warranties whatsoever, either express or implied, regarding the usefulness of the Service to Members, its fitness for Members’ particular purposes, its merchantability, its non-infringement, its being free of defects, that the Service will be available or uninterrupted, or that NIKON will continue to provide the Service.
- 2. Use of the Various Services is at the Member’s own risk. The Member receives only the limited and revocable right to use the Service, and NIKON does not license to Members the copyrights, patent rights, trademark rights, and other intellectual property rights of NIKON and third parties pertaining to the Service and/or the content and programs related to the use of the Service (collectively, the “Nikon Property”). NIKON and/or its licensors own and shall retain all rights, title and interest in and to the Nikon Property at all times.
- 3. Although NIKON has implemented systems to prevent the occurrence of incidents in the use of the Service to an appropriate and reasonable extent, NIKON makes no, and hereby disclaims all representations and/or warranties whatsoever, that the Service will be free of any computer virus or other components that could possibly infect or damage computer equipment or other assets.
VIII. Disclaimer
- 1. NIKON assumes no responsibility whatsoever for any liability and/or damage or loss incurred by Members, other customers, or third parties arising from or related to the matters described below:
- a. Access to or inability to access the Service; or
- b. Use of or inability to use the Service.
- 2. NIKON provides the Service AS-IS in its current state, and assumes no responsibility whatsoever for any liability and/or damages arising from the Service, the contents of the Service, the accuracy of its information, or the legality, morality, or permission of rights pertaining to any of the foregoing.
- 3. NIKON shall have no, and hereby disclaims all responsibility and/or liability whatsoever for any conflicts that occur between the Member and third parties (including, but not limited to, defamation, insults, invasion of privacy, infringement of publicity rights, and slander) in the services NIKON provides through the Service.
- 4. NIKON shall have no, and hereby disclaims all liability and/or damages arising from any delay or non-delivery of e-mail or other messages, incorrect display of the Service, or loss or damage of posted works (including texts and other writings, images, data, software, music and other audio, drawings, videos and any other content posted or otherwise uploaded on the Internet, including Nikon Cloud, whether public or private) due to a malfunction of the computer systems involved in the operation of the Service or to any other cause outside of NIKON’s reasonable control. Where NIKON deems it reasonably necessary, NIKON may change, suspend, or discontinue the Service, or restrict the use of certain functions, for system maintenance or other purposes. If any such actions materially affect your rights, we will use reasonable commercial efforts to provide you with prior notice of such action to the extent possible and feasible. As a result, NIKON shall not be under any obligation whatsoever, and hereby disclaims any responsibility and/or liability to the Member or anyone else for any liability and/or damages incurred by the Member or anyone else arising out of or due to suspension or discontinuation of the Service or due to changes in service content.
- 5. NIKON shall have no, and hereby disclaims all liability and/or responsibility whatsoever for damage arising out of any computer virus infections or the like incurred by the Member arising out of downloading content from or otherwise using or accessing the Service or external websites.
- 6. If it is determined by the applicable court or arbiter that the damage incurred by the Member in relation to the Service is due to willful misconduct or gross negligence on the part of NIKON (including, in this section, representatives or employees of NIKON), any provisions in these Terms that exempt NIKON from liability or limit its liability shall not apply.
- 7. Notwithstanding anything to the contrary in these Terms, NIKON’s total liability for damages to the Member under these Terms or otherwise in connection with the Service shall be limited to ordinary and direct damages actually incurred by the Member and shall in no event exceed USD$250.00. IN NO EVENT SHALL NIKON BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL OR PUNITIVE DAMAGES OF ANY KIND WHATSOEVER OR FOR ANY REASON UNDER THESE TERMS AND/OR OTHERWISE IN CONNECTION WITH THE SERVICE, EVEN IF NIKON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IX. Use of Encrypted Communication
- NIKON endeavors to protect the contents of Members’ communications via the Service by using encrypted communications (SSL/TLS) to the extent possible.
X. Prohibition of Use by Young People
- Persons who fall under any of the following items are not permitted to register for or use the Service.
- a. Persons below the age at which a contract can be concluded without the consent of a parent or guardian under the applicable laws of the Member’s home country or place of residence.
- b. Persons classified as minors under the applicable laws of the Member’s home country or place of residence.
XI. Method of Notification or Contact
- 1. If it is necessary for NIKON to give notification to the Member, NIKON shall do so by sending the notification to the then-current e-mail address of the Member registered for the Service. If such a method is taken, it shall be deemed conclusively that NIKON has given notification to the Member, regardless of whether the Member has actually received the email notification or confirmed the content or not.
- 2. Please be aware that even if you notify NIKON about a change in your Registered Information such as your e-mail address, there may be a time lag between the date NIKON receives the notice and the date that the change is reflected due to matters of system operation, and there is a possibility that NIKON will contact the previous email address designated for notifications as a security check.

XII. Withdrawal/Removal from the Service (Deletion of Nikon ID)
- 1. If the Member wishes to cancel or terminate its membership or otherwise withdraw from the Service (“withdrawal”), they may do so by logging into their account with the Services and following the withdrawal procedures prescribed by NIKON. However, in order to withdraw from the Service, the Member must first withdraw from all of the Various Services for which they have registered.
Note, however, that there may be a time lag between the date NIKON receives the notice and the date that the withdrawal procedure to be completed due to the requirements of the system. - 2. NIKON may remove any Member from the Service and all of the Various Services it is registered to (“removal”), if any of the following circumstances apply to the Member or if NIKON in good faith believes that there is a risk of such a circumstance occurring:
- a. A violation of these Terms;
- b. Falsehood, inaccuracy or error in the Registered Information;
- c. The death of the Member;
- d. None of the Various Services have been registered for by the Member more than 30 days after the Member’s registration for the Service; or
- e. Other circumstances in which NIKON reasonably deems that the Member is not eligible to use the Service.
- 3. NIKON will use reasonable commercial efforts to provide the Member with no less than 15 days prior notice of the removal, unless the removal arises from a matter that is beyond our control or for which a provision of such advance notice is not possible or feasible.
- 4. Upon withdrawal or removal from the Service, the following items pertaining to the Member shall be deleted or the relevant rights shall be revoked. NIKON may delete these items or revoke these rights if one of the conditions listed in Section XII.2 “Withdrawal/Removal from the Service (Deletion of Nikon ID)” of these Terms of Use is met:
- a. Authorization to use the Service;
- b. Authentication Information, Registered Information and any other personal information related to the use of the Service;
- c. All data submitted or provided by Member that is related to the Service; and
- d. All rights related to the Service, including but not limited to the right to receive information via email.
XIII. Preclusion of Disclaimers and Limitations of Liability
- In regard to the liability of NIKON under these Terms, the limitation or exclusion of certain warranties or the limitation of liability for certain damage caused may not be permitted under applicable law and shall not apply to the extent prohibited by applicable law, provided that such exclusions or limitations shall only apply to the maximum extent permitted by applicable law.
NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE TERMS, IF YOU ARE A CONSUMER IN THE UNITED STATES, THESE TERMS ARE INTENDED TO BE ONLY AS BROAD AND INCLUSIVE AS IS PERMITTED BY THE LAWS OF YOUR STATE OF RESIDENCE. IF YOU ARE A NEW JERSEY, USA CONSUMER, THE TERMS OF SECTIONS IV(4), VI(2), VII, VIII AND XX DO NOT LIMIT OR WAIVE YOUR RIGHTS AS A CONSUMER UNDER NEW JERSEY LAW AND THESE PROVISIONS ARE INTENDED TO BE ONLY AS BROAD AND INCLUSIVE AS IS PERMITTED BY THE LAWS OF THE STATE OF NEW JERSEY.
XIV. Prohibition on the Transfer of Rights and Obligations
- Membership status and the rights and obligations based thereon may not be transferred, assigned, or pledged as collateral to a third party, except in cases in which prior written permission has been granted by NIKON.
XV. Non-waiver of Rights or Privileges
- Any failure on the part of NIKON to exercise any of its rights or privileges under these Terms shall not constitute a waiver of such rights or privileges by NIKON.
XVI. Elimination of Antisocial Forces
- 1. In using the Service, the Member represents that they neither belong to nor fall under the definition of organized crime groups, organized crime group members, organized crime group-affiliated businesses, corporate racketeers, extortionists operating under the pretext of social activism or political movements, crime groups with specific intelligence, or other antisocial forces (hereinafter referred to as “Organized Crime Groups or Other Antisocial Forces”), and that they are not involved with any Organized Crime Groups or Other Antisocial Forces, and covenants that they will not belong to, fall under, or be involved with any Organized Crime Groups or Other Antisocial Forces in the future.
- 2. If NIKON reasonably deems that the Member belongs to, falls under, or is involved with any Organized Crime Groups or Other Antisocial Forces, NIKON may take such actions as suspending or discontinuing the Member’s use of the Service, or removing the Member from the Service, without prior notice, etc.
- 3. NIKON assumes no obligation or responsibility for, and hereby disclaims, any liability and/or damages caused to or imposed on the Member or third parties as a result of suspension or discontinuation of use of the Service or the removal from the Service in the preceding paragraph due to the Member's violation.
XVII. Severability
- Even if any provision of these Terms is deemed invalid or unenforceable due to applicable laws and regulations related to the Service, all other provisions shall be unaffected and shall remain in force.
XVIII. Changes to These Terms
- 1. The terms and conditions of these Terms may be changed by NIKON at any time in its sole discretion.
- 2. When changing these Terms pursuant to the preceding paragraph, NIKON will notify the Member of the changes to these Terms, the terms and conditions of the changed Terms of Use, and their effective date in the manner specified in Section XI “Method of Notification or Contact”. Changes to the terms will take effect at least 15 days after Notification.
- 3. If the Member uses the Service (including, but not limited to, logging into any of the Various Services using their Nikon ID) after the effective date of changes to the terms and conditions of these Terms, such use shall constitute the Member’s agreement to the changed Terms. On the contrary, if the Member does not wish the new Terms to apply, the Member should discontinue its use of the Service and request withdrawal of its account with the Service before the changes to the new Terms come into force.
XIX. Continuation of Effect of These Terms
- Regardless of a Member’s withdrawal or removal from the Service, these Terms shall continue to apply to the former Member for 2 years after the termination of these Terms.
XX. Governing Laws and Agreed Jurisdiction
- 1. These Terms shall be governed by and construed in accordance with the laws of Japan.
- 2. For any disputes arising out of or in connection with these Terms, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
XXI. Scope of Application
- 1. These Terms shall only apply to the Members who reside in the areas and countries listed in Appendix.
- 2. Although there might be multiple translations of these Terms of Use, the English version shall govern in the event of a conflict between the translations of these Terms.
